Welcome to GymFast ("we," "our," or "us"). GymFast is a gym management platform operated by Acasa Labs, a company registered in India. These Terms and Conditions ("Terms") govern your use of our web dashboard, staff mobile app, and member mobile app (collectively, the "Service") available at gymfast.app.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Definitions
- "Service" refers to the GymFast platform, including the web dashboard (gymfast.app), staff mobile app, and member mobile app.
- "User" refers to any person who accesses or uses the Service, including gym owners, administrators, staff, trainers, and members.
- "Gym Owner" refers to the person or entity that subscribes to GymFast to manage their gym.
- "Gym Administrator" refers to users with owner or admin roles who manage gym settings, staff, and members.
- "Staff" refers to users with staff or trainer roles assigned by the Gym Administrator.
- "Member" refers to gym members whose accounts are created by the Gym Administrator or Staff.
- "Content" refers to any data, text, images, or other information uploaded, entered, or generated through the Service.
- "Subscription" refers to the paid plan that grants access to the Service.
3. Account Registration and Access
3.1 Invite-Only Access
GymFast operates on an invite-only model. There is no public self-registration. Accounts are created by:
- Platform administrators for Gym Owners.
- Gym Administrators for staff and members.
3.2 Account Responsibility
- You are responsible for maintaining the confidentiality of your account credentials.
- You must change your temporary password upon first sign-in.
- You must not share your account credentials with others.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
3.3 Account Accuracy
You agree that all information provided for your account is accurate and up-to-date. Gym Administrators are responsible for the accuracy of member and staff information they enter.
4. Acceptable Use
You agree to use the Service only for lawful purposes related to gym management. You must not:
- Use the Service for any illegal or unauthorized purpose.
- Upload or transmit malicious code, viruses, or harmful content.
- Attempt to gain unauthorized access to any part of the Service or its systems.
- Interfere with or disrupt the Service or servers connected to the Service.
- Scrape, crawl, or use automated means to access the Service without our written permission.
- Impersonate another user or misrepresent your affiliation with a gym.
- Use member data for purposes unrelated to gym management (e.g., unsolicited marketing, selling data to third parties).
- Harass, abuse, or harm other users through the Service.
- Violate any applicable laws, regulations, or third-party rights.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Subscription and Payments
5.1 Subscription Plans
GymFast offers annual subscription plans for gym management. Current pricing is available on our website at gymfast.app. Subscription details, including features and pricing, are communicated during the onboarding process.
5.2 Payment Terms
- Subscriptions are billed annually.
- All prices are in Indian Rupees (INR) and exclusive of applicable taxes (GST).
- Payment is due at the start of each subscription period.
- We reserve the right to modify pricing with 30 days' advance notice before your next renewal.
5.3 Refunds
- Refund requests are handled on a case-by-case basis.
- Please refer to our Refund Policy page for detailed information.

5.4 Subscription Cancellation
- You may cancel your subscription at any time by contacting us.
- Cancellation takes effect at the end of the current billing period.
- No partial refunds are provided for unused portions of the subscription period unless otherwise stated in our Refund Policy.
- Upon cancellation, your data will remain accessible for export for 90 days, after which it will be deleted.
6. Data Ownership and Responsibility
6.1 Your Data
- Gym Owners retain ownership of all data entered into the Service, including member information, billing records, attendance data, and other gym-related content.
- You grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service.
6.2 Data Accuracy
- Gym Administrators are responsible for the accuracy and legality of the data they enter, including member personal information.
- Gym Administrators must obtain appropriate consent from members before entering their personal data into the Service.
6.3 Data Protection
We handle your data in accordance with our Privacy Policy. By using the Service, you acknowledge and agree to our data practices as described therein.
6.4 Data Export
You may request an export of your data at any time by contacting support@gymfast.app. We will provide your data in a standard, machine-readable format within a reasonable timeframe.
7. Intellectual Property
7.1 Our Property
The Service, including its design, code, features, branding, logos, and documentation, is the intellectual property of Acasa Labs. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
7.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use and incorporate such feedback into the Service without obligation to you.
8. Third-Party Services
The Service integrates with third-party services (e.g., Supabase for data storage, Vercel for hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
9. Service Availability
9.1 Uptime
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with advance notice when possible.
9.2 Modifications
We reserve the right to modify, update, or discontinue any feature of the Service at any time. For material changes that affect your use, we will provide reasonable advance notice.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that the Service will meet your specific requirements, be error-free, or be available at all times.
- In no event shall Acasa Labs, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Acasa Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights.
- Data you enter into the Service.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India.
12.2 Arbitration
Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted in Surat, Gujarat, India, in English.
12.3 Exceptions
Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property rights or data security breaches.
13. Termination
13.1 By You
You may stop using the Service at any time. To cancel your subscription, contact us at support@gymfast.app.
13.2 By Us
We may suspend or terminate your access to the Service if:
- You violate these Terms.
- Your subscription payment is overdue.
- Required by law.
- Necessary to protect the security or integrity of the Service.
13.3 Effect of Termination
Upon termination:
- Your right to access the Service ceases immediately.
- We will retain your data for 90 days to allow for export, after which it will be deleted.
- Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) shall survive.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Acasa Labs regarding the Service.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
14.4 Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
14.5 Force Majeure
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, strikes, government actions, or internet/power failures.
15. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. For material changes, we will notify Gym Administrators via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
